- Note
- Article 9(6) was substituted with effect from 1 October 2023 by the Building Safety Act 2022 (section 156(3)), commenced by S.I. 2023/362 (regulation 4) and, for Wales, S.I. 2023/914 (regulation 3). Before that date the findings had to be recorded only where the responsible person employed five or more employees, a licence was in force for the premises or an alterations notice required it. The five-employee condition still applies to the written health and safety policy (UK-HS-003) and to recording the significant findings of general workplace risk assessments (UK-HS-004); it does not apply to the fire record. Scotland and Northern Ireland have different rules.
